  • overtime laws for interns

    I have an employee that worked less than 40 hours in the week but came in on Saturday and worked 3 hours. Does he receive overtime for this?

    Under federal law, no.  40 hours or less in a calendar work week is straight time in every situation under the Fair Labor Standards Act.

     

    You may be under the influence of a state law that is more strict or is particularly focused on interns but I don't know of one that would grant overtime for what I assume is assigning someone a 6th work day in a week and under 40 horus total.

    It also may depend on how your "workweek" is defined and where Saturday falls in that workweek.
