  • Lift Truck Battery Storage Area

Our facility had some spillage from the lead acid batteries in the lift truck storage area. The waste was neutralized for safety (handling) purposes. The area was then pressure washed and all the waste material collected in a drum for disposal. Do I need to label this waste as hazardous because of the point of generation or non hazardous because of the neutralization? Please advise

I would think that the disposal I.D. would probably still need to be labeled as hazardous waste.

If the material is neutralized (ph >2.5, <12), it is not a hazardous waste. If it is aqueous, a simple pH check will tell the story. If it is a solid, you may need to get an analytical characterization to make the determination. It would need to be evaluated for both the hazardous waste and shipping requirements.

I suspect you did have some hazardous waste to start with prior to neutralization.  This must be counted towards your generator status for the month or year.  (If you exceed the 220 lbs/month for generation you kick up from CESQG status to Small status etc.)  The neutralized waste is non-hazardous however you may need permission to dispose this down the drain from your wastewater permitting agency.
