I think it depend upon why the rule was vacated. If it was because the rule was unconstitutional or vague, similar state rules would be held to the same standard. If it was because of some technical issue, I can reasonably see the rule being withdrawn and reissued in a short period of time. Call your state regulators and see what they say.
