  • If an employee loses their PPE that was given to them at the beginning of employement are they required to pay for the replacement or do we have to give it to them free of charge?

    I think it depends upon the PPE that was lost. Check the latest vesion of OSHA's PPE rule.

    The standard clearly states:

    1910.132(h)(5)

    The employer must pay for replacement PPE, except when the employee has lost or intentionally damaged the PPE.

    Just make sure you treat everyone the same, if one loses it and the company pays, then the next person who loses it should also get the same treatment.  I would also think it would depend on what the PPE is and how long they had had it.  If it is something that they have had for five years and probably needed replacing anyway, maybe the company should pay.  If they had the PPE for a few days, then the employee pays for it.  Doing it this way would require a written policy on each PPE and length of time before the company would pay for a replacement.

    Or you could just stick to the OSHA rule and say, "you lost it, you pay for it and you can not work without it."

    OSHA's new PPE payment rule (published November 15, 2007) included OSHA comments about each part of the rule, including the following recommendations to employers concerning PPE replacement for lost items:
    The rule would not require the employer to provide and pay for replacement PPE whenever requested by an employee. OSHA recommends that each employer establish a policy concerning what will constitute normal wear and tear (expected service life), a "lost" PPE item, how to safeguard against PPE abuse and negligence, and for allowing (or disallowing) employees to use PPE for personal activities that are not work related. In OSHA's view, it is up to the employer to determine how he or she chooses to deal with situations in which an employee has lost or caused damage to required PPE.
