In the FR today, EPA released a final rule that amends the All Appropriate Inquiries Rule to reference ASTM International's E2247-08 ``Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process for Forestland or Rural Property'' and allow for its use to satisfy the statutory requirements for conducting all appropriate inquiries under CERCLA.
The register stated that the rule would be finalized if no persuasive negative comments were received. Does anyone know why this would be controversial? I am thinking of advising a client to use the ASTM standard to establish AAI, but if there is a delay, I may rethink it.
