  • pesticides exemption

    So I just saw on this site that EPA's final rule for the pesticides exemption from NPDES permitting has been vacated. Does anyone know when this will be enforced? I have a client who is applying pesticides without a permit (started operations after the final rule went into effect), and I am wondering if the company should cease applying the pesticides immediately, or if there is some sort of grace period.

    At this time, EPA is not requiring a NPDES aquatic pesticide permit for the application of pesticides in, near, or around U.S. waters. However, EPA is required to develop and issue an aquatic pesticide permit by April 2011.
